Data protection notice

This notice has been prepared under Article 10 of Law No. 6698 on the Protection of Personal Data (“KVKK”) and the Communiqué on the Procedures and Principles to be Followed in Fulfilling the Obligation to Inform, in order to inform you about the personal data processed through our website and our communication channels.

Data controller

Your personal data is processed by Att. Aydın Yaman (Aydın Yaman Law Office, İncirli Çk. Sok. No: 2/3, Bakırköy,Istanbul) as data controller.

Personal data processed

  • Identity and contact details: name, surname, e-mail address and telephone number.
  • Request details: messages you send and documents you share by e-mail, telephone or WhatsApp.
  • Newsletter subscription: if an e-newsletter is offered, the name and e-mail address you provide when subscribing.
  • Transaction security data: the IP address, browser type and time of access processed by the hosting infrastructure when you visit the website.

Before an attorney–client relationship is established, we recommend that you do not send special categories of personal data, such as health data or criminal convictions, or detailed documents unless necessary, through the communication channels.

Purposes of processing

  • Responding to your contact requests and scheduling meetings,
  • Assessing your request for legal services and carrying out the process of establishing representation,
  • If an e-newsletter is offered and you subscribe, sending informative content,
  • Ensuring the security and operation of the website,
  • Fulfilling legal obligations and responding to requests from competent authorities.

Method of collection and legal grounds

Your personal data is collected when you send it by e-mail, telephone, WhatsApp and, if offered, the newsletter subscription form; transaction security data is collected by automated means when you visit the website.

This data is processed on the legal grounds set out in Article 5(2) of the KVKK: processing being directly related to the establishment or performance of a contract (c), compliance with a legal obligation of the data controller (ç), the establishment, exercise or protection of a right (e) and the legitimate interests of the data controller, provided that your fundamental rights and freedoms are not harmed (f). Sending the e-newsletter is based on your explicit consent, which you may withdraw at any time.

Transfers

Limited to the purposes above, your personal data may be transferred to the e-mail service provider (Google LLC), the website hosting and security infrastructure provider (Cloudflare, Inc.), the messaging service provider (WhatsApp) if you choose to use it, and public institutions and judicial authorities authorised by law.

As these service providers’ servers may be located abroad, your data may be transferred abroad in accordance with the procedures and conditions laid down in Article 9 of the KVKK.

Retention period

Your personal data is retained for as long as the purpose of processing requires and for the periods laid down in the relevant legislation; at the end of these periods it is erased, destroyed or anonymised.

Your rights

Under Article 11 of the KVKK, by applying to the data controller you have the right to:

  • learn whether your personal data is processed,
  • request information if it has been processed,
  • learn the purpose of processing and whether it is used in line with that purpose,
  • know the third parties to whom it is transferred in Turkey or abroad,
  • request rectification if it is incomplete or inaccurate,
  • request erasure or destruction under the conditions in Article 7 of the KVKK,
  • request that rectification, erasure and destruction be notified to third parties to whom it was transferred,
  • object to a result against you arising from the analysis of the processed data exclusively by automated systems,
  • claim compensation if you suffer damage due to unlawful processing.

Applications

In accordance with the Communiqué on the Procedures and Principles of Application to the Data Controller, you may submit requests regarding your rights in writing to the office address above, or by secure electronic signature, mobile signature or from an e-mail address you have previously notified to the office and which is in its records, to [email protected]. Your request will be concluded free of charge within thirty days at the latest, depending on its nature.
